Client Obligations
When engaging our services, you agree to:
- Provide accurate and complete project requirements
- Make timely payments as agreed in the project contract
- Provide necessary feedback and approvals within reasonable timeframes
- Ensure you have legal rights to any content you provide
Intellectual Property
Upon full payment, clients receive ownership of custom-developed code and designs created specifically for their project. Motaouakkel retains rights to general methodologies, tools, and pre-existing components used in development.
Payment Terms
Payment terms are specified in individual project contracts. Generally, we require a deposit before project commencement, with remaining payments tied to project milestones. Late payments may result in project suspension.
Warranties
We warrant that our services will be provided with professional skill and care. We offer a warranty period for bug fixes on delivered projects as specified in your contract. We do not guarantee specific business outcomes or results.
Limitation of Liability
Motaouakkel's liability is limited to the amount paid for services. We are not liable for indirect, incidental, or consequential damages including lost profits, data loss, or business interruption.
Termination
Either party may terminate a project agreement with written notice. Upon termination, the client pays for work completed and receives deliverables produced up to that point. Termination does not affect rights that have already accrued.
Governing Law
These terms are governed by the laws of Morocco. Any disputes will be resolved through negotiation first, followed by mediation or arbitration in Casablanca if necessary.
